Enforceable Civil Process
All documents must be either issued in or domesticated within the State of Florida. Any enforceable process requiring in excess of one hour will be charged at the rate of $35 per hour per deputy (rate includes $3 per hour fee for use of NCSO uniform and patrol car, which is paid to NCSO). If anticipated, an estimated cost deposit will be required in addition to the original cost deposit.
Writ of Possession / Writ of Ejectment
Fee: $90 per Writ; First Hour of service included, additional hour(s) is $35 per hour per deputy (rate includes $3 per hour fee for use of NCSO uniform and patrol car, which is paid to NCSO).
*Fee’s quoted are for on-duty officers. If you require off-duty officers, please contact the civil processing office for the correct fee structure.
Landlord/Tenant Requirements

*All Writs of Possession must be accompanied by an information sheet listing the contact person who will meet the Deputy Sheriff and accept possession of the premises.
Writ of Replevin
Fee: Writ of Replevin $90.00
***If you wish to have a Summons served at the same time as the Writ of Replevin then the fee will be $130.00. An additional fee of $40.00 will be assessed for each additional person to be served.
Requirements:
- a self-addressed stamped envelope
- Two copies of writ (the original writ and a certified copy)
- Copy of Final Judgment/Order
- Copy of Bond
- Cover letter stating who will accept possession of the property and that the plaintiff will provide labor and equipment necessary to complete the replevin
Distress Writ
Fee: $40 per defendant
Requirements:
- Two certified copies of the original writ (original Writ and a certified copy)

Civil Warrants/Orders of Contempt & Civil Commitment/Capias/Writ of Attachment
(property)/ Writ of Bodily Attachment*
All Warrants issued from a county outside of Nassau MUST be forwarded to our office by the Sheriff’s
Office of the issuing county. Fee: $90 per Warrant
Warrants to be served within Nassau County
Requirements:
- Two (2) copies of Order, the original and a certified copy
- Check made payable to Sheriff of Nassau County
- Information Sheet: Must indicate address, date of birth, and description of subject (i.e., race, sex, etc.)
Warrants to be forwarded to Any Other County
Requirements:
- Three (3) copies of Order, the original and to (2) certified copies
- Check made payable to the Sheriff of the appropriate county
- Information Sheet: Must indicate address, date of birth, and description of subject (i.e., race, sex, etc.)
*Additional Requirements for Writ of Bodily Attachment: Civil orders of arrest (excluding writs of attachment for child support) require an additional deposit of $48.11 per day that the individual is to beincarcerated. If the number of days are not given, a deposit equaling five (5) days incarceration will be required in advance. Additionally, you will be financially responsible for all medical costs incurred while the individual is in custody. {F.S.S. 30.231 (2)}
Writ of Execution– LEVY
Levy Instructions: Must be accompanied by a cost deposit. An original Writ of Execution must accompany the Instructions for Levy along with a copy of the Judgment Lien Certificate and a Creditors Affidavit. Cost deposits are collected in advance – FSS 30.231(3)

Deposit Requirement for LEVY*:
* These cost deposits are an estimate of the costs (Sheriff’s fees, towing and storage fees, advertising fees, recording fees, etc.) involved with a LEVY. Should the actual costs incurred be greater than the cost deposit, the plaintiff and/or attorney directing the LEVY will be responsible for any additional charges.
Vehicles, boats, motorcycles, etc. $3,000

Levy Instructions: Must be accompanied by a DMV print-out. The name(s) on the DMV print-out must match those on the Writ of Execution EXACTLY. If they do not, you must furnish an Affidavit of Same Name, stating the reason you believe that they are one and the same.
Real Estate $1,500
The Levy Instructions must contain a common or street address for the property. If the location is a vacant lot, you must furnish complete and specific directions to the property. A certified copy of the final judgment must be recorded with the Clerk of the Circuit Court in order to establish priority. A legal description and a copy of a warranty deed for that property must be provided by the plaintiff or the plaintiff’s attorney.
Airplane/Boat/Household Items/Business Inventory, etc. $1,500 (minimum)
Cost deposits on these types of items are determined on an individual basis. Call to obtain the amount and have available all the specifics involved with your levy: type of property, location, how much property is to be seized, etc.

NON-ENFORCEABLE CIVIL PROCESS
As of Jan 1, 2023: the public will have to contact a
Special Process Server person to serve non-enforceable
process, instead of the Civil Division serving this process. The Civil Division will have the approved list they can provide
to the public as requested. Please note, this does not change the
fact that NCSO will still serve Enforceable Service of
Process. Non-Enforceable Service of Process includes, for
example: 1) Notice of Hearing. 2) Notice of involuntary assessment. 3) Rule to show
cause (three (3) types of cases: Divorce, Replevin, Forfeiture). 4)
Subpoena Duces Tecum. 5) Summons. 6) Witness Subpoena. 7) Eviction

The Warrants Clerk also handles coordinating information with multiple law enforcement agencies for transport and extradition of subjects from other jurisdictions.
The Nassau County Sheriffs Office is unable to release any information on outstanding warrants to the public over the phone. Warrant information must be acquired “in person” or by contacting the Criminal Division at the Nassau County Courthouse.
